Terms of Service
Welcome to Kids Under Construction. These Terms of Service (“Terms”) govern your use of our website and educational services. By accessing our website, enrolling in services, or participating in tutoring sessions, you agree to these Terms.
If you do not agree with these Terms, please do not use our website or services.

Kids Under Construction provides individualized and group tutoring, as well as homeschool academic support, using research-based, constructivist and multi-sensory techniques. Through strengths assessments, learning style inventories, and diagnostic evaluations, we create mastery-based learning plans that build executive functioning, academic skills, and confidence—so students achieve meaningful, measurable outcomes.

Eligibility and Parental Consent
Our services are designed for minors and must be enrolled by a parent or legal guardian. By enrolling a student, you confirm that you are the student’s parent or legal guardian and that you consent to the student’s participation in services.

Services & Instruction
Kids Under Construction provides research-based, constructivist, and multi-sensory educational instruction. Instructional plans are individualized based on assessments, observations, and student progress.
While we are committed to high-quality instruction and measurable growth, academic outcomes, grades, or test scores are not guaranteed, as progress depends on many factors including student participation, consistency, and effort.

Billing & Payment Terms
By submitting your credit card, you consent the initiation of payments on your behalf for services that we provide to you.

Tutoring sessions are billed monthly in advance based on the number of sessions scheduled for that month.

Fees are charged to the credit card on file on the first day of each month.

Monthly charges may vary depending on the number of scheduled sessions in a given month.

Credit card information may be updated at any time through your TeachWorks account.
Failure to maintain a valid payment method may result in suspension or termination of services.

Rescheduling Sessions
We understand that scheduling conflicts can occur.​

For sessions that begin after 12:00 p.m., reschedule requests made before 9:00 a.m. on the day of the scheduled session may be rescheduled for a different day or time.

For sessions that take place in the morning and begin before 12:00 p.m., reschedule requests made before 6:00 p.m. on the day before the scheduled session may be rescheduled for a different day or time.

Rescheduled sessions must take place by the end of the following month, provided the student remains actively enrolled.

Reschedule requests made after the deadlines indicated above are not eligible for rescheduling, refunds, or credits.

All rescheduled sessions must be coordinated directly with your tutor.

Refunds & Credits
Kids Under Construction does not offer refunds or credits applied to credit cards on file, except in cases of billing errors.
Rescheduled sessions:

Must be completed while the student is actively enrolled

May not be carried forward as a credit or discount
-
May not replace or reduce future monthly tuition
​
Cancellations & Breaks
Kids Under Construction does not schedule tutoring sessions during:

Fall/Thanksgiving break (1 week)

Winter/Christmas break (2 weeks)
-
Spring/Easter break (1 week)
Families may cancel one additional week per school year outside of scheduled breaks. All other missed sessions may be rescheduled with appropriate notice but are not eligible for cancellation.
A 30-day written notice is required to terminate services. Tuition remains due during the notice period.

Student Participation & Expectations
To support a productive learning environment, students are expected to:

Follow tutor guidance

Bring required materials to sessions
Kids Under Construction reserves the right to modify or discontinue services if a student’s behavior significantly disrupts instruction or poses a safety concern.

Website Use
You agree to use our website for lawful purposes only. You may not:

Attempt to interfere with website functionality

Submit false or misleading information

Copy or distribute website content without permission
All website content, including text and graphics, is the property of Kids Under Construction and may not be used without written consent.

Privacy & Children's Data
We respect your privacy and are committed to protecting personal and student information. Please review our Privacy Policy for details regarding data collection, use, and protection.
Student information is collected only with parental consent and used solely for educational and operational purposes.

Limitation of Liability
To the fullest extent permitted by law, Kids Under Construction shall not be liable for indirect, incidental, or consequential damages arising from participation in services or use of our website.
Educational services are provided “as is,” without warranties of specific academic outcomes.

Termination of Services
Kids Under Construction reserves the right to suspend or terminate services for:

Non-payment

Violation of these Terms

Disruptive or unsafe behavior

Failure to comply with policies
Families may terminate services with 30 days’ written notice.

Confidentiality
Any written, printed, graphic, electronically or magnetically recorded information furnished by Kids Under Construction for your use is the sole property of Kids Under Construction. This proprietary information includes, but is not limited to, curriculum, books, charts, graphs, marketing plans, reports, processes and any information concerning Kids Under Construction’s employees, clients, products, services, prices, or operations. You shall keep this confidential information in the strictest confidence, and will not disclose it by any means to any person except with Kids Under Construction's written approval. On termination of this agreement or at the request of Kids Under Construction, you shall return any confidential information in your possession to Kids Under Construction within five days.

Non-Solicitation
For a period of one year following the termination of this agreement, you agree not to do either of the following: (1) call on, solicit, or take away any of Kids Under Construction's tutors that you know of or become aware of as a result of contracting services under this agreement or (2) solicit or hire away any of Kids Under Construction's other tutors that you know of or become aware of as a result of performing services under this agreement. You agree that in the event of a breach of this provision, it would be impracticable or extremely difficult to fix the actual damage and, therefore, the breaching party will pay to the non-breaching party as liquidated damages, and not as a penalty, the minimum sum of $1,500.00 per student, which falls within the criteria above. This amount represents reasonable compensation for the loss incurred because of the breach and can be greater if Kids Under Construction can prove damages to be in a greater amount.

Changes to these Terms
Kids Under Construction may update these Terms from time to time. Updates will be posted on this page, and continued use of services constitutes acceptance of the revised Terms.

Governing Law
​These Terms shall be governed by and interpreted in accordance with the laws of the state of Tennessee, without regard to conflict of law principles.
